1. Who and what
These terms are a contract between Pwnera SAS (we, us), whose details are in the legal notice, and the person or organization that creates an account or uses Artbucket Cloud (you). Artbucket Cloud (the Service) is the hosted Artbucket application at app.artbucket.io, BrandHub at hub.artbucket.io, the portals at *.artbucket.page and on your own domains, and its API and MCP server.
If you accept these terms for an organization, you confirm you may bind it. Paid plans are sold to businesses; if you are a consumer, the mandatory protections of the law where you live still apply to you, whatever these terms say.
The open-source core you run yourself is not the Service: its AGPL-3.0 license governs it.
2. Accounts
You must give accurate details and keep your sign-in secure. You are responsible for what happens under your account and under your organization's API keys, including what agents you connect do with them. Tell us at once at hello@artbucket.io if you think someone got in without permission.
One person may be admin of one free organization; more need a paid plan.
3. Plans, the beta and changes
The Free plan is a beta. It is free, with no end date, but it may change, lose data in an incident, or be unavailable, and it comes as is. We will say on the site and by email before anything that takes away something you rely on.
Paid plans (Team, Business) and their limits, prices and add-ons are listed on artbucket.io. Enterprise terms are agreed in writing and prevail over these where they differ.
We may change the Service and these terms. For a change that reduces your rights, we tell organization admins by email at least 30 days before it applies; if you disagree, you may cancel before then and we refund the unused part of a prepaid period.
4. Payment
Paid plans are sold through Stripe, which acts as merchant of record: Stripe charges you, adds VAT or sales tax where it applies, and issues the invoices. Stripe's own terms also apply to the purchase. Prices exclude tax.
Plans renew each month or year until cancelled. Upgrades and new add-ons are charged at once, prorated; downgrades are credited against later invoices. If a payment fails, Stripe retries it for up to 30 days, and the plan then ends. Cancellation and refunds follow the refund policy.
5. When a plan ends
When a paid plan ends, the organization goes back to the Free plan. If it then holds more than Free's storage (2 GB):
- for 30 days nothing changes, and we remind the buyer by email before each deadline;
- from day 30, the organization is read-only: people can still read and download, and portals are still served;
- on day 60, the newest files past 2 GB are moved to the trash, the oldest kept, and are deleted for good 30 days later.
Taking a plan again or bringing storage under 2 GB stops this at any point.
6. Your content
You keep every right in the files, metadata, rules and pages you put in the Service (your content). You give us the rights needed to host, copy, render, transform and serve it, only to run the Service for you and the people you share it with. We never train models on your content, and we do not sell it.
You confirm you have the rights to what you upload and publish. Content you make public (a public portal, a public BrandHub listing, a public rendition URL) can be read, copied and indexed by anyone, including agents; that is the point of publishing it.
Where your content contains personal data, we process it for you under the data processing agreement, which is part of these terms.
7. Acceptable use
You must not use the Service to:
- break the law, or infringe anyone's copyright, trademark, privacy or other rights;
- impersonate a person or organization, or present a brand you do not own as your own; a community listing of someone else's brand on BrandHub must say it is unofficial;
- host malware, phishing, or content that sexualizes minors, incites violence or harasses people;
- probe, overload or get around the Service's limits or security, except as the security policy allows;
- resell the Service without an agreement with us.
We may remove content or restrict access that breaks these rules, telling you why unless the law or safety prevents it. Brand owners and rights holders can report content to hello@artbucket.io; a listing of a brand by someone other than its owner is delisted or handed to the owner when they ask and show they hold it.
8. Agents and integrations
Agents and tools you connect (over MCP, the API or GitHub) act on your behalf, with the permissions you give them. You are responsible for their actions. Third-party services you connect are governed by their own terms.
9. Availability and support
We work to keep the Service available and your data safe, but we do not promise it will be uninterrupted or free of errors, and there is no service-level commitment except in an Enterprise agreement. Support is by email.
10. Ending the contract
You can stop at any time: cancel a plan from Settings, and an admin can delete the organization in Settings. Deleting it removes its content, with stored files purged within 30 days and backups expiring within a further 30.
We may suspend or close an account that seriously or repeatedly breaks these terms, or leaves an invoice unpaid, after notice unless the breach is serious or unlawful. If we close the Service itself, we give at least 90 days' notice so you can export your content, and refund any prepaid period we do not provide.
Your content leaves with you: downloads carry their metadata written back into the files, and the open-source core can run everything you exported.
11. Liability
Nothing here limits liability that cannot be limited by law, such as for fraud, gross negligence or personal injury. Otherwise, neither party is liable for indirect losses, such as lost profit, revenue or goodwill, and our total liability under these terms in any 12 months is limited to the amount you paid us in those 12 months, or 100 EUR if you are on the Free plan.
You will cover us against claims from third parties caused by your content or by your breach of section 7.
12. Law and disputes
French law governs these terms. Before going to court, write to hello@artbucket.io and we will try to settle it within 30 days. Failing that, the courts with jurisdiction over our registered office decide, unless you are a consumer, who may also use the courts where you live.
13. Everything else
If a clause is invalid, the rest stands. Not enforcing a clause does not waive it. You may not transfer this contract without our consent; we may transfer it to a company that takes over the Service, with notice to you. These terms, the documents they link to and any Enterprise agreement are the whole agreement between us about the Service.
